Zenith Dumpsters - Liability Waiver Agreement

You hereby acknowledge and agree to the terms and conditions outlined in this liability waiver "Agreement" before renting a dumpster from Zenith Dumpsters. You understand that we shall not be held liable for any damages to the ground or any property caused during the delivery, placement, or removal of the rented dumpster. By signing for this Agreement, you acknowledge and accept full responsibility for selecting the appropriate location for the dumpster and any potential damages that may occur as a result.

Non-Compliant Fee:

Return trip fee for overloaded dumpster, blocked dumpster, or a dumpster containing materials not accepted for landfill disposal is $150 or 1/3 of haul rate, whichever is greater. A $2.50 per minute fee plus disposal charges will be charge to process and handle any materials deposited in dumpster which are banned from being buried at landfills.

Payment Collection:

You agree to make payments for any and all charges contained herein. If a credit card is initially used for payment, you agree to allow Zenith Dumpster Rentals to charge subsequent charges and fees contained herein to the credit card. You agree to make immediate payment for all fees and charges and to pay 1.5% annual interest and all attorney fees, court costs, and lien processing fees for past due balances.

Driving Areas and Equipment

You agree to provide unobstructed access to equipment for Zenith Dumpster Rentals during service times. You agree to defend, indemnify, and hold harmless Zenith Dumpster Rentals against any damaged caused by trucks or equipment to pavement, curbs, driveways, or any driving surface or service areas. Additionally, you agree not to overload containers by weight (8 tons maximum payload) or by volume.

Assumption of Risk:

You acknowledge that there are certain risks associated with the placement of a dumpster on the designated location, including but not limited to damage to the ground, pavement, grass, landscaping, driveways, and other property. You fully understand and accept these risks and hereby assume all liability for any potential damages that may arise.

Release of Liability:

You release Zenith Dumpsters, its employees, agents, representatives, and affiliates from any and all claims, demands, actions, causes of action, liabilities, costs, or expenses arising out of or in any way related to any damages caused to the ground or property as a result of the dumpster rental and placement, regardless of the cause or negligence.

Indemnification:

You agree to indemnify, defend, and hold harmless Zenith Dumpsters, its employees, agents, representatives, and affiliates from and against any claims, damages, liabilities, losses, or expenses (including reasonable attorney fees) arising out of or in connection with any damages caused to the ground or property during the rental period.

Duty to Inspect:

You understand that it is your responsibility to inspect the designated location for the dumpster placement to ensure it is suitable and capable of supporting the weight and size of the dumpster without causing any damage. If you have any concerns about the suitability of the location, it is your duty to inform Zenith Dumpsters before the delivery of the dumpster.

Agreement Binding:

This Agreement shall be binding upon you, your heirs, personal representatives, successors, and assigns. You acknowledge that you have carefully read this Agreement, fully understand its contents, and voluntarily enter into this Agreement.
